Terms and Conditions for contribution to and publication in PCF’s Syringe Driver Database
The Royal Pharmaceutical Society trading as Pharmaceutical Press (“the Publisher”, “We”, “Us” or “Our”), are happy to learn that you would like to contribute to our published database: PCF’s Syringe Driver Database (including any special, shortened and subsequent editions and derivative work)(“the Work”) which is to be edited by such persons as We may appoint( “Editor”).
We invite contribution (“Contribution”) to the PCF’s Syringe Driver Database from clinical health professionals and by making a submission you warrant that you hold appropriate qualifications. You can submit a Contribution by creating a profile on our website and uploading your Contribution through the PCF’s Syringe Driver Database portal. All contributions must comply with our Acceptable Use Policy.
We agree to publish your Contribution in the Work subject to the following terms which you accept by ticking the box to confirm that you have agree the terms applicable to submission of the Contribution:
1. We may decline to publish the Contribution if you do not fully comply or agree with these terms and conditions (“this Agreement”).
2. You warrant that the Contribution is your own original work, has not previously been published, and is not currently under consideration by another publication. If the Contribution contains material which is subject to someone else’s copyright, you warrant that you have obtained the permission referred to in paragraph 3 below from the copyright owner and that the material is clearly identified and acknowledged within the Contribution. You also warrant that the Contribution will not (a) contain anything that you know to be clinical unsafe or misleading, or which is obscene, indecent, defamatory or illegal, (b) infringe anyone’s copyright or other rights (c) contain any information capable of identifying any living individual or otherwise protected by data protection laws or (d) give rise to breach of any existing agreement, including contract of employment. You further warrant that all facts purported in the Contribution are true and that any recipe, formula or instruction contained in the Contribution will not, if followed accurately, cause injury or illness or damage to the user.
3. If any material in the Contribution is subject to third party copyright, you will obtain permission from such third party(s), and provide us with evidence of such permission, for said material to be used in the Contribution and Work in all editions, forms and media and in any editions of the Work licensed by Us to third parties in any language or form throughout the world.
4. You agree that we may use, copy, distribute, edit and disclose your Contribution for any purpose. In consideration of the continuing editing and publication of the your Contribution by Us, You, by way of assignment of present and future copyright, hereby assign to Us the entire copyright and all other rights of a like nature in and to your Contribution throughout the world (including all digital rights) for the full term of such rights and all renewals, revivals and extensions thereof, and We shall have the exclusive right during such period to publish, and to license for publication, the Contribution in whole or in part in all editions, forms and media in the English language and in any translation without limitation.
5. We may at our sole discretion include the Contribution in any special, subsequent, revised version or versions of the Work.
6. We shall have the right to make any revision to the Contribution which we may deem desirable in the interests of uniformity and style of Work. We shall have the final decision on the inclusion or omission of the Contribution in or from the Work and any subsequent editions.
7. We will acknowledge you as the author of the Contribution in the Work. You hereby waive your moral rights you may have relating to the Contribution pursuant to Copyright, Designs and Patents Act 1988 and any other moral rights or similar rights under any legislation now existing or in future enacted in any part of the world.
8. If We add you to Our professional indemnity insurance policy in respect of your Contribution, you will comply with all conditions imposed by the insurer.
This Agreement and all claims arising from it shall be governed by and construed in accordance with the laws of England and parties agree to submit to the exclusive jurisdiction of the English Courts.
